1. Scope of Application
These Terms and Conditions of Sale govern the sale of artworks by Tsukimi Gallery whether via its website or catalogue, to private or professional clients.

3. Artworks Offered
The artworks offered for sale are original pieces. Each artwork listing provides the following information, where applicable: title, artist, dimensions, materials/technique, and price.
4. Availability
Artworks are offered for sale while stocks last. In the event of unavailability after an order, the client will be informed and refunded promptly.
5. Price
Prices are indicated in euros, including all taxes (VAT), excluding delivery costs. The price charged is that displayed at the time of order confirmation. The gallery reserves the right to modify its prices at any time.
6. Order
Placing an order implies unconditional acceptance of these Terms and Conditions. The order becomes final upon payment confirmation and email validation.
7. Payment
Payment can be made by bank transfer or through a secure payment provider (e.g., PayPal). Orders will only be processed once full payment has been received.
8. Delivery
Deliveries are made to the address provided by the client. Delivery costs and times vary depending on the artwork’s size, delivery location, and chosen carrier. The client will be informed by email of the order tracking. Packaging, transport, insurance, and any customs fees are not included in the displayed price. The gallery is available to assist clients in obtaining a transport quote if needed.
9. Withdrawal (Private Clients Only)
In accordance with Article L221-18 of the French Consumer Code, the client has 14 days from receipt to exercise their right of withdrawal. The artwork must be returned at the client’s expense and in its original condition. Refunds will be issued within 14 days of receipt.
10. Claims – Returns
In case of damage upon receipt, the client must notify the gallery within 48 hours, with supporting photographs. Liability for sold items transfers to the carrier upon collection or drop-off. No returns will be accepted without prior agreement.
11. Warranties
Maxime Mauchamp strives to provide as accurate information as possible on tsukimigallery.com However, the gallery cannot be held responsible for omissions, inaccuracies, or failures to update information, whether caused by itself or by third-party partners providing this information.
12. Intellectual Property
Purchasing an artwork does not grant any rights to reproduce or exploit the texts and images published on our website. Any unauthorized use is prohibited.
13. Applicable Law – Disputes
These Terms and Conditions are governed by French law. In the event of a dispute, the parties will seek an amicable solution. Failing this, the competent courts will be those of the defendant’s domicile (or, for professionals, the gallery’s registered office).
